1. Who we are and what this policy covers

This Privacy Policy describes how Form Industries ("Form Industries", "we", "us" or "our"), a Normal Corporation company registered in Hawaii and California and the maker of Airform heating and cooling products, collects, uses and shares information when you visit this website, join a waitlist, configure a product, place a pre-order or deposit, or contact us. It applies to this website and to communications with us about our products. By using the site you agree to this policy and to our Terms of Use.

2. Information you provide to us

We collect the information you choose to give us: your name and email address when you register interest, join a waitlist or send us a message; the contents of messages you send through the contact window; your installation location and address when you configure a product; your bedroom count, color and installation choices when you build a configuration; company details if you enquire for a building or development; and order details, including your email for receipts, when you place a pre-order or deposit.

3. Information collected automatically

When you visit the site we collect standard technical information such as your IP address, browser type, device and operating system, the pages you view and how you interact with them, and the page that referred you. Until you accept cookies, our analytics run without writing anything to your device and this information is not linked to you as a person. See section 4 for what changes if you accept cookies.

4. Cookies and analytics

We use PostHog to understand how the site is used. When you first visit, analytics run in a cookieless mode: nothing is stored on your device, no session recordings are made, and no personal identifiers are attached to events. If you accept cookies through the banner, we store an analytics identifier in cookies and local storage so we can recognize repeat visits, and we may record how sessions interact with the page to improve the product. If you decline, we remain in cookieless mode and clear any analytics cookies. We also use local storage for functional preferences that are not used for tracking, such as your cookie choice and language selection. Our payment provider, Stripe, sets its own cookies inside its payment fields for security and fraud prevention.

5. Address search and maps

The address field in the configurator uses the OpenStreetMap Nominatim service to suggest addresses. When you type in that field, the text you type is sent to OpenStreetMap to return matching addresses, subject to the OpenStreetMap Foundation's privacy policy. We send only the text of your search, never your name or contact details.

6. Payments

When you pre-order, the card authorization or bank debit is processed by Stripe on this site: your card number or bank account details are entered directly with Stripe and never touch our servers, and we receive confirmation of payment, the amount, and limited billing information such as your name, email and payment method type. If you confirm by card, Stripe keeps the card on file against your order so that the order total can be charged to it later; we can see only the card brand and last four digits. Stripe processes your data as described in its own privacy policy.

If you confirm with a bank account, you link it through Stripe Financial Connections. With your permission during that step, Stripe reads the linked account’s available balance so we can confirm it covers the order before debiting; we see only whether the balance is sufficient at that moment, and we do not store balances or transaction history.

7. Service providers

We share information with service providers who process it on our behalf and only as needed to run the site and our business: Stripe for payments; Brevo for transactional email, waitlists and relaying contact messages; PostHog for analytics; and our hosting and infrastructure providers. Each provider is bound by contract to protect your information and use it only to provide services to us.

8. How we use information

We use the information described above to provide and improve the site and our products; to process pre-orders, deposits and refunds; to respond to messages and enquiries; to contact you about availability, delivery and installation in your area; to send service and marketing emails you have signed up for, which you can opt out of at any time using the link in each email; to understand how the site is used; to detect and prevent fraud and abuse; and to comply with law.

9. How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only with the service providers described in section 7; with installation partners you ask us to connect you with, limited to what they need to contact you about your installation; as part of a merger, acquisition or sale of assets, in which case this policy continues to apply; and where required by law, legal process or to protect our rights, users or the public.

10. Data retention

We keep personal information only as long as needed for the purposes above: waitlist and contact details until you ask us to remove them or the enquiry is closed; order and payment records as long as required for tax, accounting and warranty purposes; and analytics data for the retention period configured with our analytics provider. When information is no longer needed we delete or anonymize it.

11. Security

We use appropriate technical and organizational measures to protect your information, including encryption in transit, access controls and hosting with reputable providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security; if we learn of a breach affecting your personal information we will notify you as required by law.

12. Your rights and choices

You can ask us to access, correct, delete or export the personal information we hold about you, and you can withdraw consent to analytics cookies at any time by clearing your browser storage for this site, after which the banner will ask again. California residents have the right under the CCPA to know what personal information we collect, use and share, to request deletion and correction, to opt out of sale or sharing (we do neither), and not to be discriminated against for exercising these rights. To exercise any right, email legal@formindustries.co; we will verify your request and respond within the time required by law. You may use an authorized agent, and we may ask the agent for proof of authorization.

13. Children

This site is not directed to children and our products are sold to adults. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us personal information, contact us at legal@formindustries.co and we will delete it.

14. Visitors from outside the United States

We are based in the United States and the site is intended for customers in the locations where our products are offered. If you visit from elsewhere, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.

15. Changes to this policy

We may update this policy as the site and our products evolve. The "Last updated" date above reflects the latest version, and material changes will be flagged on this page or by email where appropriate. Your continued use of the site after changes take effect means you accept the updated policy.
